DMV Hearings: Protecting Your Driver's License

In California, the DUI/DWI process can be confusing, since two separate areas of the law must be addressed in a timely manner. Anyone charged with drunk driving will need to work with a criminal defense attorney highly skilled in handling criminal trials and hearings with the California Department of Motor Vehicles (DMV).

At the Law Office of Ivan O.B. Morse, we handle both the criminal and administrative sides of DUI/DWI charges. Criminal defense attorney Ivan O.B. Morse is a former police officer with the skills and legal resources to help you navigate through the criminal justice system and the administrative process. He is committed to defending your constitutional rights, while seeking to protect your driving privileges. Contact our law firm today to schedule a free initial consultation.

If you have been charged with a DUI/DWI, you only have 10 days to schedule a hearing with the California Department of Motor Vehicles. Failing to schedule this hearing within 10 days may result in the automatic suspension of your driver's license. This hearing could mean the difference between keeping and losing your driver's license.

California's 10-Day Rule

As soon as you are arrested for drunk driving, the police will confiscate your driver's license and issue a 30-day pink paper (DS 367) to serve as your temporary driving permit. You then have 10-calendar days from the date of your arrest to schedule an administrative hearing with the DMV.

The DMV will not automatically give you a hearing — you must ask for it. It is crucial that you set up this hearing within 10 days following your arrest. If you do not request a hearing, you will have a revoked license after your 30-day temporary permit has expired.
